Terms of Service

1. Acceptance of Terms

By accessing or using the Vyrfy platform at vyrfy.app ("Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.

2. Description of Service

Vyrfy provides a human-verified creative testing platform that enables brands to challenge creators, collect short-form video submissions, and validate content performance through matched human testers. We act as a marketplace connecting brands, creators, and testers.

3. Eligibility

You must be at least 18 years old to use the Platform. By registering, you confirm that you are at least 18 and have the legal capacity to enter into a binding agreement.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@vyrfy.app if you suspect unauthorised access.

5. Brand Responsibilities

• Provide accurate, complete, and lawful briefs.
• Ensure challenge requirements comply with applicable advertising standards.
• Funds held in escrow are released only upon verified completion of challenges.
• Do not use the platform to promote illegal, harmful, or misleading content.

6. Creator Responsibilities

• Submit only original content you own or have the right to use.
• Comply fully with challenge briefs, including required and banned content.
• By submitting content, you grant Vyrfy a licence to display, distribute, and test your content within the Platform.
• Vyrfy is not liable for creative work that does not pass AI compliance checks.

7. Tester Responsibilities

• Provide honest, genuine engagement and feedback.
• Do not attempt to manipulate test results.
• Micro-rewards are earned only for completing valid testing tasks.

8. Payments and Escrow

Brand payments are held in escrow until challenge completion. Vyrfy charges a platform fee detailed in your subscription or challenge agreement. All fees are non-refundable except as required by applicable law or as explicitly stated in your agreement.

9. Prohibited Conduct

• Circumventing AI compliance or tester validation systems.
• Uploading content that infringes intellectual property rights.
• Harassing, threatening, or deceiving other users.
• Attempting to reverse-engineer, scrape, or disrupt the Platform.

10. Intellectual Property

All Platform technology, branding, and proprietary data (including aggregated attention datasets) belong to Vyrfy. User-uploaded content remains the property of the respective uploader, subject to the licence granted in Section 6.

11. Disclaimers

The Platform is provided "as is". Vyrfy does not guarantee specific campaign results, creator earnings, or tester availability. We are not liable for indirect, incidental, or consequential damages arising from your use of the Platform.

12. Termination

We may suspend or terminate your account for breach of these Terms, at our discretion, with or without notice. You may close your account at any time by contacting support@vyrfy.app.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law provisions. Disputes shall be resolved through binding arbitration in accordance with AAA rules, except where prohibited by law.

14. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or a platform notice. Continued use of the Platform after changes constitutes acceptance.
